Improper classification of employees as exempt under the Fair Labor Standards Act and non-compliance with exemption regulations can generate some of the largest back pay awards and fines for a company. Furthermore, penalties and back wages are computed with the same formula for all companies—large or small. Improper exempt employee classification and compliance infractions can be devastating or ruinous to employers. Yet employers often are caught off guard when an improper classification is found either by an auditor, a regulator or—in the worst case—a plantiff’s attorney. Furthermore, if a problem is uncovered by a company, often the problem remains how to correct it in a timely and fair manor for both the affected employees and the company without getting into trouble.
